Official Rules and Terms

NO PURCHASE NECESSARY. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. ODDS DEPEND ON NUMBER OF ELIGIBLE ENTRIES RECEIVED. OPEN ONLY TO RESIDENTS OF THE STATE OF FLORIDA. INTERNET ACCESS IS REQUIRED.

READ THESE RULES BEFORE ENTERING. Participation constitutes your full and unconditional agreement to these Official Rules, including but not limited to, the consent to receive communications related to this Giveaway, a class action waiver, a jury trial waiver, and other important terms and conditions affecting your rights.

Eligibility. This Ugliest HVAC Giveaway (the “Giveaway”) is open to Florida residents located in Florida, aged 18 years or older, at the time of entry and winner must own a home in the Mid Florida Heating and Air service areas. Void where prohibited or restricted by law. Subject to all applicable federal, state, and local laws. Employees of Cascade Residential Services LLC (“Sponsor”), its affiliates, subsidiaries, including without limitation Mid Florida Heating & Air, and advertising and promotion agencies, and each of their immediate family members (parent, child, spouse or sibling and their respective spouses, regardless of where they reside) and those living in their same households, whether or not related, are not eligible to enter or win. By participating, entrants agree to be bound by these Official Rules and the decisions of the Sponsor, which are binding and final on matters relating to this Giveaway.

Entry Period. Giveaway begins January 2, 2025 at 12:01 a.m. (Eastern Time) through February 28, 2025 at 11:59 p.m. (Eastern Time) (the “Entry Period”). Sponsor’s computer is the official time keeping device for this Giveaway.

How to Enter. During the Entry Period, visit the Giveaway website at https://www.midfla.com/contest to fill out an online form with your name, address, phone number, and email. You will also be asked to share a short description detailing why you own the ugliest HVAC, heater, or a/c unit. This entry form will also allow entrants to attach a photo of their HVAC, heater, or a/c unit, if so inclined.

By entering, you consent to sharing your first name, last name, home address, email address, and phone number with Sponsor, and you consent to receiving email and/or phone communications from Sponsor regarding the Giveaway.

Limit one entry per person, per email address, and per phone number throughout the Entry Period. Multiple entrants are not permitted to share the same email address or phone number. Entries received from any person, email address, or phone number more than the stated limitation will be void. Entries generated by any means which subvert the entry process are void. Entries become the property of the Sponsor and will not be acknowledged or returned.

Proof of submission does not constitute proof of receipt. Entrants must have a valid email address and it is the entrant’s responsibility to update the Sponsor of any change in email address. By entering this Giveaway, you agree to these Official Rules and Terms in full. Proof of submission does not constitute proof of receipt. Sponsor is not responsible for lost, late, incomplete, stolen, inaccurate, misdirected, damaged, delayed, garbled, incorrect, or undelivered entries. Entries become the property of the Sponsor and will not be acknowledged or returned. By entering this Giveaway, you agree to these Official Rules in full.

CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS GIVEAWAY IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW.

In the event of a dispute over who submitted an online entry, all online entries will be deemed to have been submitted by the owner of the ISP account from which they were sent and he/she must comply with these Official Rules. For these purposes, an ISP account holder shall mean the natural person assigned to such ISP account by the Internet access provider, online service provider or other organization responsible for assigning ISP addresses for the domain associated with such ISP account. Any questions regarding the number of entries submitted or the owner of an ISP account shall be determined by Sponsor in its sole discretion, and Sponsor reserves the right to disqualify any entries by persons determined to be tampering with or abusing any aspect of the Giveaway.

How to Win and Winner Notification. One (1) potential winner will be selected by random drawing from among all eligible entries received after the close of the Entry Period. Winner must acknowledge notification in the manner specified herein and as specified in communication from Sponsor or risks forfeiting prize to an alternate randomly selected winner. Potential winner may be required to execute and return an affidavit of eligibility, a liability release and, where lawful, publicity release within fourteen (14) days of date of notification of winning. Sponsor will issue an IRS Form 1099 for the winner; any potential winner who fails to provide all necessary information, including without limitation, valid and proper identification, will forfeit the Prize. If any such requested documentation and/or information is not received by the Sponsor within the specified time period, and in the manner specified by the Sponsor, if the Sponsor is unable to contact a potential winner, or a potential winner is not in compliance with these Official Rules, the Prize will be forfeited and an alternate potential winner may be selected for the applicable drawing. Selection of a potential winner thereafter is at the Sponsor’s discretion; after two attempts to award the Prize, the Sponsor is not under any obligation to select a winner and award the Prize, but may choose to attempt to do so. Prize awards are subject to verification of eligibility and validation of compliance with these Official Rules. No more than the number of prizes stated herein will be awarded. If, for whatever reason, the Sponsor receives more valid prize claims for any drawing than the number of prizes stated herein, the Sponsor may, in its sole discretion, award the stated number of prizes at issue to among all non-suspect, eligible claims received for such a prize. A person may only win once in this Giveaway. Winner will be announced on or about March 7, 2025.

Odds. Odds of winning depend on the number of eligible entries received.

Prize. One winner will receive a new residential HVAC system with installation (the “Prize”). Total ARV: $20,000.00. HVAC to be installed shall be determined at the sole discretion of Sponsor and under no circumstances will value of system and installation costs exceed a total of $20,000. Prize awarded “as is” with no warranty or guarantee, either express or implied by the Sponsor, unless otherwise expressly stated upon installation. Prize is not transferable. Prize is not redeemable for cash or greater value. The Sponsor reserves the right, in its sole discretion, to substitute prize (or portions thereof) with one of comparable value. All federal, state, and local taxes, if any, as well as any other costs and expenses associated with the acceptance and use of the Prize not specified herein as being awarded are the sole responsibility of each individual winner. All Prize details are in the Sponsor’s sole discretion. Unclaimed prizes will not be awarded.

General Conditions. Sponsor and all Released Parties (as defined below) are not responsible for lost, late, incomplete, illegible, unintelligible, stolen, inaccurate, misdirected, damaged, delayed, garbled, incorrect, erroneously deleted, or undelivered entries, or for failure to receive entries during the Entry Period due to transmission failures or technical failures of any kind, including, without limitation, malfunctioning of any network, hardware or software, whether originating with sender or Sponsor or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Giveaway, including, without limitation, errors or difficulties which may occur in connection with the administration of the Giveaway, the processing of entries, the announcement of a Prize, the cancellation or postponement of the Giveaway, or in any Giveaway-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by any equipment or programming associated with or utilized in the Giveaway or otherwise.

Persons who tamper with or abuse any aspect of the Giveaway or who are otherwise in violation of these Official Rules, as solely determined by the Sponsor, will be disqualified and all associated entries will be void. Should any portion of the Giveaway be unable to run as planned for any reason, including if, in the Sponsor’s sole opinion, the Giveaway is compromised by nonauthorized human intervention or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of entries, the Sponsor reserves the right in its sole discretion to suspend, modify, or terminate the Giveaway, and, if terminated, select the potential winner(s) for the random drawing(s) at issue from all eligible, nonsuspect entries received for the applicable drawing(s) prior to action taken. Entrants, by participating, agree that the Sponsor, and its respective parents, affiliates, subsidiaries, advertising and promotion agencies, and all of their respective officers, directors, employees, representatives and agents (collectively, “Released Parties”) will have no liability whatsoever for, and shall be held harmless by entrants against, any liability for any injuries, losses, or damages of any kind, including death, to persons, or property resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of a Prize or participation in this Giveaway. By acceptance of Prize, except where legally prohibited, winner grants permission for the Sponsor and its designees to use his/her name, address (city and state), photograph, voice and/or other likeness and prize information for advertising, trade, and promotional purposes without further compensation, in all media now known or hereafter discovered, worldwide, and on the Internet and world wide web, in perpetuity, without notice or review or approval. Void wherever prohibited or restricted by law. All federal, state, and local laws and regulations apply. Prize recipients will be solely responsible for paying all applicable federal, state and local taxes on prizes, and where applicable, winner will receive an IRS Form 1099 for the retail value of any prizes. Potential winner must provide all required personal information for issuance of same to Sponsor in manner requested by Sponsor or risk forfeiting the Prize.

The Sponsor’s decisions as to the administration and operation of the Giveaway and the selection of the potential Prize winner(s), are final and binding.

Limitations. Limit one entry per person, per email, and per phone number. Multiple entrants are not permitted to share the same email address or phone number. All entries must be fully and accurately completed and in compliance with these Official Rules. Use of any automated system to participate in the Giveaway or subvert the entry process is prohibited and will result in disqualification and all associated entries will be void. Sponsor reserves the right to cancel, suspend and/or modify the Giveaway, any prize drawing(s), or any part thereof if any fraud, technical failures, human error, or any other factor impairs the integrity or proper functioning of any of the foregoing, or any event or cause beyond Sponsor’s control (e.g.. events such as natural calamities, national emergencies, wide spread illnesses, declarations of war, acts of God, acts of terrorism) interferes with any aspect of the Giveaway or the drawing, including but not limited to fulfillment of the Prize, as determined by Sponsor in its sole discretion. In such event, Sponsor, in its sole discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance and may modify the Prize(s) offered herein. By entering this Giveaway, you agree to these Official Rules and Terms in full.

Publicity. Except where prohibited, participation in the Giveaway constitutes winner’s consent to Sponsor’s and its respective agents’ use of winner’s name, likeness, photograph, voice, opinions and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration.

Privacy Policy. Entry requires submission of certain information, including name, address, phone number, and email address. Sponsor processes information that identifies or is linked to an individual Entrant (“Personal Information”) in order to administer the Giveaway pursuant to these Official Rules and to comply with legal obligations, consistent with Sponsor’s privacy policy. Sponsor shall retain Personal Information for as long as necessary for the purpose(s) the Personal Information was collected and consistent with its privacy policy. By entering into this Giveaway, each entrant expressly consents to the Sponsor, its agents and/or representatives, collecting, storing, sharing and using the Personal Information submitted at the time of entry for the purpose of administering the Giveaway, unless the entrant agrees otherwise. You may be offered the opportunity to receive additional communications from Sponsor as well. By participating in this Giveaway and submitting an entry, you agree to receive by mail, email, phone call, or text message communications from the Sponsor in the administration of this Giveaway. If at any point you do not wish to receive such communications, including at time of entry, you may choose to opt out at any time. No communication unrelated to the contest, commercial or otherwise, will be sent to the entrant by the Sponsor, unless the entrant has otherwise authorized the Sponsor to do so or as permitted by applicable law. If you choose to opt out of communications from Sponsor during the pendency of this Giveaway, you may forfeit your opportunity to win if Sponsor is thereby unable to contact you.

Disputes. This Giveaway is governed by, and shall be construed in accordance with, the laws of the State of Florida, and if any dispute, controversy, claim, or loss cannot otherwise be resolved through direct discussions or voluntary and non-binding mediation, any such disputes, controversies, claims, or losses shall be resolved exclusively by a state or federal court sitting in Hillsborough County, Florida. Any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with participating in this Giveaway, but in no event attorneys’ fees. Under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Giveaway or the Prize drawing(s), shall be governed by, and construed in accordance with, the laws of the State of Florida without giving effect to any choice of law or conflict of law rules (whether of the State of Florida or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Florida. By entering, entrant also agrees to hereby expressly and irrevocably waive all rights to trial by jury in any action or proceeding instituted relating in any way or arising in any way out of the Promotion. All entrants, as a condition of entry, agree to be bound by these Official Rules and the decisions of the Sponsor, which shall be final and binding. Sponsor reserves the right in its sole discretion to disqualify any and all individuals (and their entries) who tamper with the entry process. The remedy for any claim SHALL BE LIMITED TO ACTUAL DAMAGES, AND IN NO EVENT SHALL ANY PARTY BE ENTITLED TO RECOVER PUNITIVE, EXEMPLARY, CONSEQUENTIAL OR INCIDENTAL DAMAGES OR HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED, INCLUDING ATTORNEYS’ FEES OR OTHER SUCH RELATED COSTS OF BRINGING A CLAIM, OR TO RESCIND THIS AGREEMENT OR SEEK INJUNCTIVE OR ANY OTHER EQUITABLE RELIEF. Entrants agree that they are hereby WAIVING ANY RIGHT TO A JURY TRIAL. Entrants agree that the rights and obligations of any Entrant and/or the Released Parties and/or any other party SHALL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION.
